A quick scan of Booker / Fanfan makes it appear that federal sentencing guidelines are now advisory in nature. As someone who's been living in a State with non-binding guidelines for the extent of my legal career I'd like to welcome all ya'll federal lawyers to my world.
If the guidelines are only advisory they shouldn't be a grounds of appeal. Since the guidelines seem to be 75% of all appellate cases now, I wonder how appellate lawyers will earn their living in the future?
